Terms of Service
tree friend is made by DRIFTLAB, LLC ("we," "us"), a New York limited liability company, located at 42 Broadway, Fl. 12-200, New York, NY 10004. These terms cover using the game and the license to the one-time unlock; the sale of the unlock itself is made by Paddle, our merchant of record (see The purchase). By using tree friend you agree to these terms.
The game
tree friend runs on your device. There are no accounts, and for almost every player your progress is held only on your device — a small, opt-in creator programme with hosted saves is the one exception. Nothing about the game is designed to compete for your attention. See our Privacy Notice for exactly what we do and don't collect.
Using it
You may use tree friend for your own personal, non-commercial enjoyment. You may not use the game, or any content within it, in a way that violates any law, is fraudulent or deceptive or spam, infringes anyone's rights, or interferes with the security or operation of the game or its infrastructure — including introducing malware, probing or scraping the service, or attempting unauthorised access.
The purchase
The free version is a complete single-tree game: you raise one tree from sprout to maturity, and it stays fully yours to tend even after it stops growing. On the web, a one-time purchase of $3.99 USD unlocks succession — planting the next generation, and the grove of every tree that came before. This is a single purchase, not a subscription. There is no recurring charge. In the iOS app, generations are currently included at no charge — there is no in-app purchase there.
Purchases are processed by Paddle.com Market Ltd, who acts as the merchant of record for this transaction — Paddle is the seller you are contracting with for payment purposes, is responsible for processing your payment, and handles applicable sales tax. Paddle's own Checkout Buyer Terms govern the checkout itself, in addition to these terms. See our Refund Policy for how refunds work.
License
We grant you a personal, non-transferable license to use tree friend and the features you have paid for, for your own enjoyment. The game, its software, its art, and its writing belong to DRIFTLAB, LLC, and we retain all right, title, and interest in them. Nothing here transfers ownership of any of it to you.
Suspension
We may suspend or end your access to tree friend where there is a material breach of these terms, a security or fraud risk to us or other players, or repeated violations. Where we do, any associated purchase may be cancelled and refunded through Paddle.
No warranty
tree friend is provided as-is and as available. We built it carefully and mean for it to work, but we make no guarantee it will be uninterrupted or error-free, and to the extent the law allows, we disclaim warranties beyond that.
Limitation of liability
To the fullest extent permitted by law, DRIFTLAB, LLC is not liable for indirect, incidental, or consequential losses arising from your use of tree friend, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these terms limits or excludes liability that cannot be limited or excluded by law — including, for consumers in the European Union or the United Kingdom, your statutory rights, and liability for death or personal injury caused by negligence, or for fraud.
Changes
We may update these terms as the game changes. The effective date above reflects the latest version, and continued use of tree friend after a change is posted is acceptance of the updated terms.
Governing law
These terms are governed by the laws of the State of New York, and disputes belong in the state or federal courts sitting in New York County. If you are a consumer, this does not deprive you of the protection of the mandatory laws of your country of residence, or of your right to bring a claim in your local courts where the law gives you one.
